Acceptance of these terms

These Terms of Use govern your access to and use of the Jenica of All Trades website and its public and members-only features. By using the site, you agree to these terms. If you do not agree, do not use the site.

You must be at least 18 years old and legally able to enter into these terms to submit a business, service, membership, or network inquiry.

Website information is not a service agreement

The website describes possible services, examples, opinions, recommendations, and past work. Website content is general information and does not create a client, contractor, employment, fiduciary, agency, partnership, or other professional relationship.

Submitting an inquiry, client note, network application, membership request, or message does not guarantee acceptance, availability, a response, pricing, a referral, work, membership, or any particular outcome. Services begin only after JOAT and the applicable party enter into a separate written agreement or otherwise expressly confirm the engagement.

Website content is not legal, medical, tax, accounting, investment, insurance, or other regulated professional advice.

Intellectual property

The website, including its copy, design, branding, logos, layouts, graphics, videos, original photographs, downloadable materials, and arrangement of content, is owned by or licensed to Jenica Of All Trades, LLC and is protected by applicable intellectual-property laws.

You may view and use the website for your own lawful, personal, or internal business evaluation. You may not reproduce, scrape, republish, sell, license, modify, distribute, create derivative works from, or commercially exploit website content without prior written permission, except as permitted by law.

Third-party names, trademarks, photographs, and materials remain the property of their respective owners.

User submissions and uploads

You are responsible for information, text, images, links, files, testimonials, and other material you submit. You represent that your submission is accurate to the best of your knowledge, lawful, and does not violate another person’s privacy, confidentiality, copyright, trademark, publicity, contractual, or other rights.

You grant JOAT a limited license to receive, store, review, reproduce internally, and use your submission as reasonably necessary to evaluate and respond to it, operate the website, maintain records, and administer a potential or actual relationship. JOAT may publish a client note, testimonial, name, image, or attribution only when the applicable submission includes permission to do so or another written authorization has been provided.

Do not submit malware, unlawful material, confidential information you are not authorized to share, or highly sensitive personal information through public forms.

Members-only access

Members-only access is invite-only and may be conditioned on an approved email address, account status, membership relationship, and compliance with separate agreements. You are responsible for maintaining the confidentiality of your credentials and for activity associated with your account.

You may not share credentials, attempt to access another person’s account, bypass security, copy protected materials for unauthorized use, or interfere with the portal. JOAT may suspend or terminate access when reasonably necessary for security, misuse, nonpayment, expiration, or violation of applicable terms or agreements.

Testimonials, examples, and results

Testimonials and project examples reflect individual experiences and specific circumstances. They are not promises or guarantees that another person will receive the same result. Photographs and descriptions may be edited, organized, cropped, or presented for clarity, privacy, or design while preserving the substance of the work.

Ask JOAT, the automated assistant

“Ask JOAT” is an automated, website-based informational assistant. It is software, not Jenica Bates or any other person, and a conversation with it is not a conversation with JOAT staff. Its responses are generated automatically and may be incomplete, out of date, or incorrect.

Nothing Ask JOAT produces is a quote, a price, an offer, an acceptance, a commitment to perform work, a guarantee of availability, or legal, financial, medical, tax, or other professional advice. It cannot create, modify, or waive any agreement, and it cannot bind Jenica Of All Trades, LLC. Where anything it says conflicts with these terms, a written proposal, or a signed agreement, that other document governs. Please confirm anything you intend to rely on with a person before acting on it.

Do not use Ask JOAT to transmit passwords, payment or banking details, government identification, medical or health records, exact private addresses or access information, or anyone else’s confidential information. Recent conversation history is stored temporarily in your browser session so the feature can work while you browse; you can clear it at any time with the “Clear chat” control. Handling of information you enter is described in the Privacy Policy and the Cookie Notice.

The assistant is offered as a convenience on an as-is basis. We may change, limit, or withdraw it at any time without notice, and we do not warrant that it will be available, accurate, or uninterrupted. Use of it is subject to the disclaimers and limitation of liability below.

Third-party links and affiliate relationships

The site may link to third-party websites, products, vendors, venues, social platforms, scheduling services, and other resources. JOAT does not control and is not responsible for third-party content, availability, security, privacy, products, services, pricing, or performance.

Some links may be affiliate links. When clearly disclosed, JOAT may earn a commission from qualifying purchases at no additional cost to you. A link or mention does not create a warranty or guarantee.

Prohibited conduct

You may not use the site to violate law or another person’s rights; impersonate another person; submit false or misleading information; transmit malicious code; attempt unauthorized access; disrupt site operation; harvest personal information; conduct automated scraping that burdens the site; or use content to train, market, or build a competing commercial product without permission.

Disclaimers

The website is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, JOAT disclaims warranties of merchantability, fitness for a particular purpose, title, noninfringement, uninterrupted availability, error-free operation, and the accuracy or completeness of website content.

JOAT may update, remove, correct, or discontinue website content or functionality at any time. We do not guarantee that files, links, forms, recommendations, or third-party services will remain available or free of harmful components.

Limitation of liability

To the fullest extent permitted by law, Jenica Of All Trades, LLC and its owners, employees, contractors, agents, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or opportunities arising from or related to use of the website.

Where liability cannot be excluded, JOAT’s total liability arising solely from use of the public website will not exceed one hundred U.S. dollars, unless a different remedy is required by law or a separate written agreement governs the matter.

Governing law and severability

These terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. If any provision is found unenforceable, the remaining provisions will remain in effect, and the unenforceable provision will be enforced to the greatest extent permitted.

Changes and contact

We may revise these terms by posting an updated version and changing the last-updated date. Continued use after an update means the revised terms apply to future use.
